These Terms and Conditions form the agreement between the Buyer or User and Al Basheq for Trade & Distribution concerning the Al Basheq Application (“Al Basheq App”) you received or granted access to. Please read these Terms and Conditions carefully prior to using the application.
1. Definitions
1.1 In these Terms and Conditions, the following definitions will be used.
Client means the person who has been allocated the privilege to use Al Basheq App through the designated username, password.
Product means all products and services available on our Application.
Terms and Conditions means these Terms and Conditions, including updates, alterations and possible appendices, published by Al Basheq Application.
Customer means the end-user of the products and services, who shall use such products and services for the final intended purpose.
You means the Client as predefined above.
2. Scope of Application
2.1 These Terms and Conditions apply in full to anyone, using, purchasing or attempting to use Al Basheq App and its corresponding products and services.
2.2 By purchasing, using or attempting to use Al Basheq App, you accept and agree that you as a Client or User are bound by these Terms and Conditions; and that you acknowledge that you have read and understood the information concerning Al Basheq App terms and conditions.
3. Purchase and Delivery of Products and Services
3.1 Al Basheq App offers electronic products and services that can be purchased and redeemed through the client and the customer. You must have a valid and authorized account with Al Basheq App to purchase or use the available products and services.
3.2 All products and services will be provided by Al Basheq App in electronic form only, through the provision of a serial or verification Code.
3.3 Once the payment of the products and services has been processed, the client and customer will receive a receipt to confirm the transaction in electronic format and different platforms available. The receipt is a confirmation of the issue date and the product and service validity date.
3.4 The products and services that can be purchased from the application are mainly dedicated for the regional use within the Hashemite Kingdom of Jordan.
4. Payment, Funds/Balance and Charges
4.1 All our products and services will be charged in Jordanian Dinars (JoD).
4.2 The Charges for the products and services will be the amount that you have selected on the Application, and will be made known to you for confirmation before you conclude your purchase. Charges must be paid in accordance with the instructions as specified by us on the application.
4.3 The payment the client makes to the agent or authorized representative from Al Basheq will refill your Fund/Balance with the corresponding payment amount; which entails the cap and allowance for the total use and purchase of Available products and services and restricted to the available balance for the client.
4.4 Your purchase only becomes final when we receive the full payment of the applicable amounts and corresponding charges. Once the payment has been received and validated, you will receive a confirmation receipt for the transaction.
5. Term of Validity
5.1 After the expiry of the term of validity of the product and service as highlighted on the receipt, after which the product and service is expired and no longer valid.
6. Returns and Cancellations
6.1 Products and services cannot be reimbursed and cannot be returned, except insofar as statutory rights provide for that, for example in the event of defects or in the circumstances as defined and determined by AL Basheq App as acceptable circumstances. The purchased products and services cannot be cancelled.
9. Loss or Theft
9.1 The title and risk of loss for products and services pass upon electronic transmission of the Products and Services by Al Basheq App to the Client. Al Basheq has no obligation to replace lost or stolen products and services, but you can report lost or stolen products and services by contacting [email protected].
10. Privacy and Data Protection
10.1 Any personal details provided in connection with the Al Basheq App will be processed in accordance with our Privacy Policy.
10.2 All data collected by us will be used and processed exclusively within the framework of the current applied data protection laws of Jordan and in accordance with our data protection and privacy policies.
11. Al Basheq’s Right to Termination, Cancellation, or Refusal of a Transaction
11.1 Al Basheq can terminate this agreement, cancel the product or service or refuse a transaction if we suspect that the product and service or the client credentials and account are being used in a fraudulent, improper, or unlawful manner, or if we have reason to assume that you are in breach of this agreement.
12. Limitation of Liability
12.1 Al Basheq accepts no liability for loss, theft, destruction or improper use of available products or services.
12.2 Al Basheq cannot be held liable for loss of turnover, use, profit, expected profit, contracts, income, goodwill, or expected savings; loss of details or use of details; or consequential loss, extraordinary loss, or indirect loss, including if it has been informed of the possibility of such loss.
12.3 Without prejudice to the conditions of this agreement, Al Basheq’s liability towards you is limited to the amount of the balance on the Application if one of the following events takes place (in which case the earliest of these events applies):
1. The product and services are cancelled by Al Basheq;
2. This agreement is terminated by Al Basheq.
12.4 Nothing in this agreement serves to exclude or limit liability for:
1. Death or personal injury due to negligence;
2. Deliberate deception;
3. Any other form of liability that cannot legally be excluded or limited.
13. Applicable Law and Dispute Resolution
13.1 All contracts concluded with Al Basheq shall be governed by Jordanian law.
13.2 Any dispute between you and Al Basheq in relation to the agreement, including the understanding and extent of these Terms and Conditions, will be resolved by the competent court in Amman, Jordan.
